Iddah for Faskh

Question
I don’t know what the ruling is on the Iddah period. I have been given a divorce through the sharia council the fask e nikah but i am not sure how long the Idda period is.
Answer
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
The Iddah period for a woman who has been given divorce through a Shariah council is as follows:
- Completion of three menstrual cycles if she experiences menses and is not expecting a child[1]
- Till birth if she is expecting a child[2]
If the woman does not experience menses and she is not pregnant, then her iddah period shall be three months.[3]
The calculation of the Iddah period should start from the day the divorce was granted to you by the Shariah council.

وإذا طلق الرجل امرأته طلاقا بائنا أو رجعيا أو وقعت الفرقة بينهما بغير طلاق وهي حرة ممن تحيض فعدتها ثلاثة أقراء ” لقوله تعالى: {وَالْمُطَلَّقَاتُ يَتَرَبَّصْنَ بِأَنْفُسِهِنَّ ثَلاثَةَ قُرُوءٍ} [البقرة: 228] والفرقة إذا كانت بغير طلاق فهي في معنى الطلاق لأن العدة وجبت للتعرف عن براءة الرحم في الفرقة الطارئة على النكاح وهذا يتحقق فيها والأقراء الحيض عندنا

وإن كانت حاملا فعدتها أن تضع حملها ” لقوله تعالى: {وَأُولاتُ الْأَحْمَالِ أَجَلُهُنَّ أَنْ يَضَعْنَ حَمْلَهُنَّ} [الطلاق: من الآية4]

” وإن كانت ممن لا تحيض من صغر أو كبر فعدتها ثلاثة أشهر ” لقوله تعالى: {وَاللَّائِي يَئِسْنَ مِنَ الْمَحِيضِ مِنْ نِسَائِكُمْ} [الطلاق: من الآية4] الآية وكذا التي بلغت بالسن ولم تحض بآخر الآية.
