Question

I wanted to find out if i should pay zakat on my deceased sisters gold? She was divorced and has no children

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, once a person passes away, the wealth does not belong to him/her. The deceased’s wealth automatically transfers in to the ownership of the inheritors.

Accordingly, the inheritors are the owners of her wealth, therefore, they are obliged to discharge Zakaat on that wealth.

However, if the one passes away whilst Zakaat was due on him/her, and he/she made a bequest, then the inheritors will be obliged to discharge Zakaat on his/her behalf from one third of the estate. And if one did not bequest for Zakaat to be discharged, then it is advisable, though not necessary for the inheritors to discharge Zakaat on behalf of the deceased. [1]

بدائع الصنائع في ترتيب الشرائع (2/ 53)

ومنها موت من عليه الزكاة من غير وصية عندنا، وعند الشافعي لا تسقط وجملة الكلام فيه أن من عليه الزكاة إذا مات قبل أدائها فلا يخلو إما أن كان، أوصى بالأداء وإما أن كان لم يوص فإن كان لم يوص تسقط عنه في أحكام الدنيا حتى لا تؤخذ من تركته ولا يؤمر الوصي أو الوارث بالأداء من تركته عندنا، وعنده تؤخذ من تركته، وعلى هذا الخلاف إذا مات من عليه صدقة الفطر، أو النذر، أو الكفارات، أو الصوم، أو الصلاة، أو النفقات، أو الخراج، أو الجزية؛ لأنه لا يستوفى من تركته عندنا، وعنده يستوفى من تركته

وَإِلَى أَنَّهُ لو مَاتَ من عليه الزَّكَاةُ لَا تُؤْخَذُ من تَرِكَتِهِ لِفَقْدِ شَرْطِ صِحَّتِهَا وهو النِّيَّةُ إلَّا إذَا أَوْصَى بها فَتُعْتَبَرُ من الثُّلُثِ كَسَائِرِ التَّبَرُّعَاتِ
