Claiming from third party insurance

After an accident are we allowed to claim from the insurance company under third party…
The other person was at fault..(so claiming from his insurance)

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The person who caused damage to your vehicle is liable for it.[1] Therefore, you can claim from him or his insurance company.

And Allah Ta’āla Knows Best

الْمُبَاشِرُ ضَامِنٌ، وَإِنْ لَمْ يَتَعَدَّ وَالْمُتَسَبِّبُ لَا إلَّا إذَا كَانَ مُتَعَدِّيًا فَلَوْ حَفَرَ بِئْرًا فِي مِلْكِهِ فَوَقَعَ فِيهَا إنْسَانٌ لَمْ يَضْمَنْهُ وَلَوْ فِي غَيْرِ مِلْكِهِ ضَمِنَهُ ذَكَرَهُ فِي الْأَشْبَاهِ
