Question
I had a question about warathat. If a mother who has only daughters leaves inheritance, does the inheritance go all to the daughters? Or does the mothers brother have a share in it
Answer
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
If a deceased leaves behind only daughters and no sons, then the maximum that will be inherited by the daughters (if two or more) will be two thirds of the estate. The remainder will be allocated to other heirs such as parents, brothers, etc. Inheritance law can only be accurately determined once one has a full list of potential existing heirs at the time of demise.
