Question

My 40 days of nifaas are over but I’m still getting yellow discharge, hence I’ve classified it as istihadha.

If this continues, when is it considered haidh?
Since ramadhan is coming, I’m worried as to what fasts I have to keep and what I don’t have to keep

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The laws of nifaas (postnatal bleeding) are as follows:[1]

  1. It is the bleeding experienced after giving birth. In the event of a miscarriage, if the child was formed such that its features are visible, then the bleeding experienced after birth will be nifaas.
  2. There is no minimum limit to nifaas. In contrast, haidh has a minimum limit of 3 days.
  3. The maximum limit of nifaas is 40 days. Any bleeding experienced after 40 days cannot be nifaas but will be istihaadha.
  4. If a woman has already given birth before, then her habit of nifaas from that birth will dictate the limit of her nifaas in the second birth. Accordingly, if a woman bled for 35 days after her first birth, after her second birth, her nifaas will be 35 days unless the bleeding goes to 40 days and stops exactly at 40 days. In this case, her nifaas habit will now be 40 days once more. If she bleeds beyond the 40th day, she will only count 35 days as nifaas and the rest as istihaadha.
  5. It is not possible to have haidh immediately after nifaas. The two must be separated by atleast a 15-day purity.
  6. After a 40-day nifaas ends (or her nifaas habit ends), the woman will apply her old habits of haidh and purity. For example, if her habit before birth was 8 days of blood and 20 days of purity, she will apply the same rule after nifaas ends. 20 days will be purity and then 8 days of blood/haidh.

Accordingly, in the enquired situation, the yellow discharge is istihaadha. Your old purity habit shall be in between the end of nifaas and the start of haidh.

قَوَاعِدُ النَّفَاسِ

القاعدة ٢٩: أقل النفاس : لا حَدَّ لَهُ. ( انظر : ص ۱۱۰).

القاعدة ٣٠ أَكْثَرُ النَّفَاسِ : أَرْبَعُونَ يَوْمًا. (انظر: ص ۱۱۱).

القاعدة ٣١: يَجِبُ التَّوَقْفُ عَنِ الصَّلاةِ وَالصِّيَامِ بِمُجَرَّدِ رُؤْيَةِ الدَّمِ فِي مُدَّةِ الْأَرْبَعِينَ. (انظر : ص ٢٠٥).

القاعدة ٣٢: يَجِبُ الْغُسْلُ بِمُجَرَّدِ انْقِطَاعِ الدَّم فِي مُدَّةِ الْأَرْبَعِينَ. (انظر : ص ١٦٢).

القاعدة ٣٣: الظُّهْرُ الْمُتَخَلَّلُ بَيْنَ الدَّمَيْنِ فِي النَّفَاسِ لَا يَفْصِلُ بَيْنَهُمَا، وَيُجْعَلُ كَالدَّمِ الْمُتَوَالِي. (انظر : ص ١١٥).

القاعدة ٣٤: إِذَا لَمْ يُجَاوِزِ الدَّمُ الْأَرْبَعِينَ فَالْكُلُّ نِفَاسٌ، إِنْ طَهُرَتْ بَعْدَهُ طُهْرًا تاما. (انظر : ص ١٤٣).

القاعدة ٣٥ : إِذَا جَاوَزَ الدَّمُ الْأَرْبَعِينَ – حَقِيقَةً أَوْ حُكْمًا – فِي الْمُعْتَادَةِ تُرَدُّ إِلَى عَادَتِهَا، وَمَا زَادَ عَلَى الْعَادَةِ اسْتِحَاضَةٌ. (انظر: صـ ١٤٣).

القاعدة ٣٦: إِذَا جَاوَزَ الدَّمُ الْأَرْبَعِينَ – حَقِيقَةً أَوْ حُكْمًا – فِي الْمُعْتَادَةِ، تُؤْمَرُ بِقَضَاءِ الصَّلَاةِ. (انظر: صـ ١٤٣).

القاعدة ٣٧: النَّفَاسَانِ لا يَتَوَالَيَانِ، وَكَذَا النَّفَاسُ وَالْخَيْضُ، بَلْ لَا بُدَّ مِنْ طُهْرٍ تَامٌ فَاصِلِ بَيْنَهُمَا. (انظر: ص ۱۱۱).

القاعدة ٣٨: يَجُوزُ خَتْمُ النَّفَاسِ بِالظُّهْرِ . (انظر : ص ١٤٠).

القاعدة ٣٩: يَجِبُّ الْغُسْلُ عِنْدَ الْخُرُوجِ مِنَ النَّفَاسِ الْحُكْمِيِّ، وَإِنْ كَانَتْ عَلَى طهر . (انظر : ص ١٤٠).

القاعدة ٤٠ : أَقَلُّ الظُّهْرِ الْفَاصِلِ بَيْنَ النَّفَاسَيْنِ سِتَّةُ أَشْهُرٍ . (انظر : ص ۱۱۲).

القاعدة ٤١: أَقَلُّ الظُّهْرِ الْفَاصِلِ بَيْنَ النَّفَاسِ وَالْحَيْضِ خَمْسَةَ عَشَرَ يَوْمًا. (انظر: ص ۱۱۲).

القاعدة ٤٢ : إِنْ أَسْقَطَتِ الْمَرْأَةُ مُسْتَبِينَ الْخَلْقِ فَمَا رَأَتْهُ مِنَ الدَّمِ بَعْدَ الْإِسْقَاطِ نِفَاسٌ. (انظر : ص ۱۲۷).
