Question
To whom it may concern .
my husband has a tendency to become angry and say stuff like pack your things and go to your house .
this time in his anger he said if you speak like that next time I will divorce you and you can go packing to your fathers .
does this count of divorce ?
what’s the status .
Answer
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
Statements such as ‘pack your things’ and ‘go to your house’ are considered to be unclear words of divorce. As such, in order for a Talaq to occur, it is necessary that the husband clearly intended divorce when he uttered these words.
As for the statement, ‘next time I will divorce you and you can go…’, then it is in the future tense. Therefore, no divorce occurs through it.
