Question
ASSALAMOALAIKUM Warahmatullahi Wabarakatuh….just wanted to ask a branch of a lemon tree from our neighbors is coming in our yard is it permissible to break lemons without asking from the neighbors? Pliz advice…. your earliest response will highly be appreciated
And what if we broke the lemons without their permission what’s the ruling?

Answer
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
The tree protruding into one’s yard belongs to the one who planted it. It is not permissible to pluck the fruits from the neighbour’s tree without the owner’s consent. [1]
If lemons were plucked without the neighbour’s consent, the neighbour should be informed and the fruits should be returned. If the neighbour gives consent to pluck the fruits, then one may do so.

الْمَادَّةُ (1196) إذَا امْتَدَّتْ أَغْصَانُ شَجَرِ بُسْتَانِ أَحَدٍ إلَى دَارِ جَارِهِ أَوْ بُسْتَانِهِ فَلِلْجَارِ أَنْ يُكَلِّفَهُ تَفْرِيغَ هَوَائِهِ بِرَبْطِ الْأَغْصَانِ وَجَرِّهَا إلَى الْوَرَاءِ أَوْ قَطْعِهَا. وَلَكِنْ لَا تُقْطَعُ الشَّجَرَةُ بِدَاعِي أَنَّ ظِلَّهَا مُضِرٌّ بِمَزْرُوعَاتِ بُسْتَانِ الْجَارِ

المسألة الثالثة: إذا غرس شجراً في طريق العامة، والحكم فيها: أن الشجرة للغارس؛ لأنه ليس له ولاية جعل للعامة
المسألة الرابعة: إذا غرس شجراً على شط نهر العامة أو على شط حوض القرية، فالحكم فيها كالحكم في المسألة الثالثة
