Question

Assalamulaikum… If I have inherited e.g about 25000$ from my father’s inheritance. And I have that amount at the time of hajj.. But I have needs as a shelter I do not have shelter of my own.. Nor does my husband have a guaranteed shelter..

He works.. So what’s the ruling regarding me going for Haj.. My husband had already Haj

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, hajj is fardh on a woman if she possesses wealth sufficient for the hajj journey, accommodation, food and all related expenses.[1] Furthermore, a woman who has to travel more than the safar distance (48 miles) for hajj can only do so if a Mahram accompanies her.[2]

If she cannot find a Mahram to accompany her, then if she has sufficient funds to pay for a Mahram to accompany her, she must do so.[3]

Providing housing and accommodation is a responsibility upon the husband. You as a wife have no obligation to provide accommodation/housing for yourself. Therefore, hajj remains fardh on you (keeping in mind the conditions mentioned above).

( وَمِنْهَا الْمَحْرَمُ لِلْمَرْأَةِ ) شَابَّةً كَانَتْ أَوْ عَجُوزًا إذَا كَانَتْ بَيْنَهَا وَبَيْنَ مَكَّةَ مَسِيرَةُ ثَلَاثَةِ أَيَّامٍ هَكَذَا فِي الْمُحِيطِ ، وَإِنْ كَانَ أَقَلَّ مِنْ ذَلِكَ حَجَّتْ بِغَيْرِ مَحْرَمٍ كَذَا فِي الْبَدَائِعِ وَالْمَحْرَمُ الزَّوْجُ ، وَمَنْ لَا يَجُوزُ مُنَاكَحَتُهَا عَلَى التَّأْبِيدِ بِقَرَابَةٍ أَوْ رَضَاعٍ أَوْ مُصَاهَرَةٍ كَذَا فِي الْخُلَاصَةِ وَيُشْتَرَطُ أَنْ يَكُونَ مَأْمُونًا عَاقِلًا بَالِغًا حُرًّا كَانَ أَوْ عَبْدًا كَافِرًا كَانَ أَوْ مُسْلِمًا هَكَذَا فِي فَتَاوَى قَاضِي خَانْ وَالْمَجُوسِيُّ إذَا كَانَ يَعْتَقِدُ إبَاحَةَ مُنَاكَحَتِهَا لَا يُسَافِرُ مَعَهَا كَذَا فِي مُحِيطِ السَّرَخْسِيِّ وَالْمُرَاهِقُ كَالْبَالِغِ وَعَبْدُ الْمَرْأَةِ لَيْسَ بِمَحْرَمٍ لَهَا كَذَا فِي الْجَوْهَرَةِ النَّيِّرَةِ وَلَا عِبْرَةَ لِلصَّبِيِّ الَّذِي لَا يَحْتَلِمُ وَالْمَجْنُونِ الَّذِي لَا يُفِيقُ كَذَا فِي مُحِيطِ السَّرَخْسِيِّ وَتَجِبُ عَلَيْهَا النَّفَقَةُ وَالرَّاحِلَةُ فِي مَالِهَا لِلْمَحْرَمِ لِيَحُجَّ بِهَا ، وَعِنْدَ وُجُودِ الْمَحْرَمِ كَانَ عَلَيْهَا أَنْ تَحُجَّ حَجَّةَ الْإِسْلَامِ ، وَإِنْ لَمْ يَأْذَنْ لَهَا زَوْجُهَا ، وَفِي النَّافِلَةِ لَا تَخْرُجُ بِغَيْرِ إذْنِ الزَّوْجِ ، وَإِنْ لَمْ يَكُنْ لَهَا مَحْرَمٌ لَا يَجِبُ عَلَيْهَا أَنْ تَتَزَوَّجَ لِلْحَجِّ كَذَا فِي فَتَاوَى قَاضِي
