Zakat to a Ghosia

Question

Assalamualaikum ww
One brother asked me. “Can one give Zakaat to a recipient of Zakaat, who is a Ghosia?”
Please advice.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, if a person from that sect does not have any beliefs which are contrary to our Aqeedah, then Zakat may be given to him. On the contrary, if they have beliefs such as ‘the Prophet Sallallahu Alaihi Wasallam is physically present everywhere’, or that ‘he has full knowledge of the unseen’, then one should not give Zakat to him.[1]

In both cases, it is better to give Zakat to the deserving amongst our own people whom we know to be on the truth without any doubt.

ومنها أن يكون مسلما فلا يجوز صرف الزكاة إلى الكافر بلا خلاف لحديث معاذ – رضي الله عنه – «خذها من أغنيائهم وردها في فقرائهم» أمر بوضع الزكاة في فقراء من يؤخذ من أغنيائهم وهم المسلمون فلا يجوز وضعها في غيرهم

وأما سوى الزكاة من صدقة الفطر والكفارات والنذور فلا شك في أن صرفها إلى فقراء المسلمين أفضل؛ لأن الصرف إليهم يقع إعانة لهم على الطاعة وهل يجوز صرفها إلى أهل الذمة قال أبو حنيفة ومحمد: يجوز، وقال أبو يوسف: لا يجوز وهو قول زفر والشافعي
