Question
السلام عليكم ورحمة الله وبركاته
If, for instance, Amina awes Aisha some money, and a long period of time has passed.. now Amina is feeling shy about the long period that has passed or (due to any other reason) she’s failing to return the amount.. Can she give away that amount in sadaqah with the intention of Amima getting the reward for it?? Would that be counted as returning the amount to Amina?
Answer
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
A loan once taken must be repaid such that the owner gets back exactly what he/she initially gave.[1] Rasulullah Sallallahu Alaihi Wasallam has warned us against unnecessarily delaying repayment of loans. Consider the following,[2]
عن أبي هريرة، أن رسولَ الله صلَّى الله عليه وسلم قال: مَطْلُ الغنى ظُلمٌ
Translation: Rasulullah Sallallahu Alaihi Wasallam said: “Delay in payment by a rich person is oppression and injustice”.
It will not suffice to give away what is owed in sadaqah on the owners behalf.

وحدثنا عن زكريا بن أبي زائدة عن عامر أنه سئل عن امرأة أقرضت امرأة عشرة مثاقيل ذهب جيد، وكان عندها ذهب رديء دونه، فأرادت أن تعطيها من ذلك الذهب اثني (4) عشر مثقالاً، فكره عامر ذلك، وقال: لتبع (5) ذهبها في السوق، ثم لتشتر (6) للآخر ذهباً

وإذا كان لرجل على رجل دينٌ: قَرْضُ دراهمَ أو دنانيرَ، فأعطاه أجود منها أو دونها برضاهما (5) فهو جائز
ولو كان حين أقرضه اشترط عليه أن يقضيه (6) أجود منها أو دونها كان هذا باطلاً لا يجوز

أما في باب القرض فالشرط اعتبار المماثلة في العين المقبوضة وصفة المالية
بدائع الصنائع في ترتيب الشرائع (7/ 395)
أن الواجب في باب القرض رد مثل المقبوض

3345 – حدَّثنا عبد الله بن مَسلَمةَ القَعْنَبيُّ: عن مالكٍ، عن أبي الزِّناد، عن الأعرجِ عن أبي هريرة، أن رسولَ الله – صلَّى الله عليه وسلم – قال: “مَطْلُ الغنى ظُلمٌ، وإذا أُتبِعَ أحدُكم على مَليءٍ فليَتْبَعْ” (2)
