Purchasing sadaqa back from the poor

Question
I have a question, if someone does goat business and gets sadqah orders to do on behalf of the customers and the customer requests the meat should amongst the helpers or the poor people. Once we’ve done say particularly regarding trotters (paya) we give it to the helpers or the poors but they don’t really like the trotters (paya), are we allowed to buy it from them and eat them?
Answer
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
It is permissible to purchase something from the poor provided they had taken possession of it and owned it before voluntarily consenting to sell it.[1]

وَالصَّدَقَةُ كَالْهِبَةِ – عِنْدَنَا – فِي أَنَّهُ لَا يُوجَبُ الْمِلْكُ لِلْمُتَصَدَّقِ عَلَيْهِ إلَّا بِالْقَبْضِ خِلَافًا لِمَالِكٍ – رَحِمَهُ اللَّهُ –
وَفِي الصَّدَقَةِ خِلَافٌ بَيْن الصَّحَابَةِ، وَمَنْ بَعْدَهُمْ – رَضِيَ اللَّهُ تَعَالَى عَنْهُمْ -، وَكَانَ عَلِيٌّ وَابْنُ مَسْعُودٍ – رَضِيَ اللَّهُ عَنْهُمَا – يَقُولَانِ: إذَا أَعْلَمْت الصَّدَقَةَ جَازَتْ، وَكَانَ ابْنُ عَبَّاسٍ وَمُعَاذٌ – رَضِيَ اللَّهُ عَنْهُمْ – يَقُولَانِ لَا تَجُوزُ الصَّدَقَةُ إلَّا مَقْبُوضَةً. وَعَنْ شُرَيْحٍ وَإِبْرَاهِيمَ النَّخَعِيِّ – رَحِمَهُمَا اللَّهُ تَعَالَى – فِيهِ رِوَايَتَانِ ذَكَرَهُمَا فِي الْكِتَابِ؛ فَأَخَذْنَا بِحَدِيثِ ابْنِ عَبَّاسٍ – رَضِيَ اللَّهُ عَنْهُمَا -، وَحَمَلْنَا قَوْلَ عَلِيٍّ، وَعَبْدِ اللَّهِ بْنِ مَسْعُودٍ – رَضِيَ اللَّهُ عَنْهُمَا – عَلَى صَدَقَةِ الرَّجُلِ عَلَى وَلَدِهِ الصَّغِيرِ، وَذَلِكَ بِالْإِعْلَامِ يَتِمُّ؛ لِأَنَّهُ يَصِيرُ قَابِضًا لَهُ

قال: “والصدقة كالهبة لا تصح إلا بالقبض”؛ لأنه تبرع كالهبة
