Question

Subject: Following the Country law
Assamualaikum,
(There is only 1 questions)
My question is that, if buying car insurance is permissible for a person as he is forced to buy that because that is the country law in order to drive cars in the Netherlands, then is it permissible for a Bangladeshi citizen to become a dutch citizen and take the oath,
‘I swear that I will respect the constitutional order of the Kingdom of the Netherlands, its freedoms and rights, and I swear that I will faithfully fulfil my obligations as a Dutch citizen’. Followed by: ‘So help me God’
As the person clearly says that he will be following the obligations upon him as a dutch citizen. As a conclusion, Does not the matter of buying insurance then become willingly as he become citizen volunteerly and took the oath of following the obligations while he was not required to take the citizenship as he had permenent residency???

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Purchasing third party insurance is permitted due to the law mandating it upon you.[1] One cannot hope to drive a car (which is his right) except after purchasing third party insurance.

Your query is very specific as it will only be applicable upon an individual who before taking the oath was not driving at all within the country. Nevertheless, taking the oath obliges one to fulfil the obligations of the country which do not violate the laws of Shari’ah. One cannot take an oath to do something impermissible. Even if one takes such an oath, it will be binding upon him to break that oath as one cannot violate the commands of Allah in any situation.

Therefore, ones oath will exempt one from that which is impermissible, despite it being a country regulation. Thereafter, the Shari’ah will create a concession in the case of third-party insurance due to the genuine need for it. Accordingly, third party insurance is permissible due to the concession, not the oath.
