Question

1. Is doing business on a consignment basis permissible? That is when a supplier supplies the goods, but the buyer/shop owner will only pay for the actual items sold. All unsold items will remain the property of the supplier.

2. I’m planning to supply English y only Qurans to bookshops. Seeing that the aim is for da’wah, any unsold copies will be given away free elsewhere, can the Qurans be supplied on a consignment basis?

3. It must be noted that I will set the price of the Qur’an and they will deduct certain commission % from the selling price.

4. If not allowed, what are the alternatives in both cases 1 and 2?

JazakAllah in advance and looking forward to your response

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

  1. Trading on consignment as described in the query should be structured as an agency agreement wherein the supplier maintains ownership as well as risk of the goods and the ‘seller’ will be his agent for a fee/commission that must be agreed upon as either a fixed sum or a percentage.[1]

In this instance, the seller/agent will be entitled to his fee for every item sold, as agreed. The goods will remain in the ownership and risk of the supplier. Should the goods be lost/damaged due to negligence of the seller/agent, then the seller/agent will be held liable.

  1. It is not permissible to publish English only Qurans.[2] Therefore, it would be better to opt for Qurans with both the Arabic as well as the English. ‘Quran made easy’ by Mufti Afzal Hoosen Ilyas Rahimahullah is well suited for da’wah purposes.
  2. It is permissible to execute the agency agreement outlined above when supplying the Qurans to bookshops. The commission earned by the seller/agent must be fixed, either as a lump sum or a set percentage of the sale price, without ambiguity.
