Question
A freind of mine…had an argument with her husband…and she said give ne a divorce…and he said haya..I’m giving u…
Then they were on
Then after an year again they had an argument and out of anger she again said give ne a divorce..and the husband said haya…
Then again after some time….again the same….
So is this like 3 talaks given?
And is this how divorce happens…
Like the husband and wife had a heated up argument and out of frustration the wife said I cannot live with u..and I want a divorce….and the husband said ok haya…
Tuen again they became ok..and then again like in a heated up argument again it happened
But after that they are ok..they have been intimated also
So has the talak happened
First time in 2008 second time in 2018 and 3rd time in 2025
Like when she was insisting him..during the argument..that I cannot live with u..and I want a divorce. He said haya talak
No iddat….coz after the quarrels they get back well
Note: ‘haya’ means ‘ok’
Clarification: First time he replied haya talaq. Second and third time he only said ‘haya’ another time he only said ‘ok’. Just to make her walk away
Answer
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
The husband and wife must be careful when it comes to divorce. It is not a matter to be taken lightly. The wife should not insist on getting a divorce given the fact that after calming down, the couple reconciles. Similarly, the husband should control himself and not utter any words of divorce.
In the enquired situation, since the wife asked her husband, ‘give me a divorce’ or ‘divorce me’, in the instance where the husband replied, ‘haya talaq’, one divorce will occur. In the instances where the husband only responded with ‘haya’ or ‘ok’, and no more, no divorce has occurred.[1]
