Question
Assalamu Alaikum
Hope you’re well Mufti SB
One person travelled from place A to B (not yet safar distance: 30 KM) with the intention that if he finds a lift to place C (safar distance from place A as well as B), he will go Place C. And if he doesn’t get a lift, he will come back to place A, and he never found a lift and came back to place A, but he made imamat at place B, so was he a musafir when he was at the place B?

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
One of the prerequisites of qasr salah is that the traveller has intended a travel distance of 48 miles or more when leaving his home.[1] Since this has not been found, the individual in question shall be a Muqeem at place B.

وأما بيان ما يصير به المقيم مسافرا: فالذي يصير المقيم به مسافرا نية مدة السفر والخروج من عمران المصر فلا بد من اعتبار ثلاثة أشياء: أحدها: مدة السفر وأقلها غير مقدر عند أصحاب الظواهر، وعند عامة العلماء مقدر، واختلفوا في التقدير قال أصحابنا: مسير ثلاثة أيام سير الإبل ومشي الأقدام وهو المذكور في ظاهر الروايات
