Question

Assalamu alaykum wa rahmatullahi wa barakatuh,

I hope you are well.

I am reaching out to request a religious ruling regarding a commercial matter.

I would like to know whether it is permissible according to Islamic jurisprudence to sell in France technical socks designed to facilitate masah during wudhu, as long as they meet the scholarly conditions (being waterproof, thick enough, covering the ankle, staying firmly on the foot, etc.).

There is currently a significant need for such a product among Muslims in France, especially in workplaces, public areas, or during travel.
Before launching this project, I want to ensure that everything is fully in line with Islamic rulings and ethical commercial practices.

Could you please clarify:

Whether selling such socks is Islamically permissible?

What conditions or disclaimers must be communicated to customers?

Whether there is any specific procedure to follow to ensure the product is marketed in a Sharia-compliant manner?

If obtaining an official fatwa is necessary, or if the existing fiqh rulings on masah are sufficient?

May Allah reward you for your guidance and your service to the Ummah.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

It is permissible to sell masah socks to the public. Infact, given the need of Muslims in today’s world, it is a commendable endeavor as one will create ease for many Muslims across the globe. Almighty Allah shall reward one based on his/her intentions.

However, masah socks need to fulfill the following requirements in order to be correctly labelled as ‘masah/wudhu socks’.[1]

  1. The thickness and quality of the sock is such that the wearer is able to walk in only the socks (no shoes) for atleast 3 miles without the socks tearing.
  2. It covers the entire foot including the ankle.
  3. The sock holds onto the shin without requiring a strap. Meaning once worn, the sock does not slip off unless pulled off by the wearer.
  4. The sock is waterproof such that if water is poured on top of it, it does not enter the inside of the sock.

As evident from the above, all 4 conditions are such that a competent Mufti or Darul Iftaa shall have to test the socks themselves before issuing a verdict endorsing them. Therefore, we advise you to work with your local Mufti/Darul Iftaa and allow them to test your product before launching it. As for product disclaimers, it would be prudent to seek legal counsel. As for marketing, it follows that all marketing should not infringe upon other laws of the Shari’ah, hence one should abstain from the use of the female awrah, music in advertisements, etc.

Once the socks have been tested and approved by a reputable Mufti or Darul Iftaa, they may then be marketed as Shari’ah compliant.
