Is it permissible to collect a vehicle Insurance pay out

Question

Assalamuikum warahmatullahi wabarakatu
If a person’s car was involved in an accident and it was not his fault. The insurance company of the guilty party is offering cash. Can a person only collect that much amount of money from the guilty party’s insurance which he has paid as insurance premiums to his insurance company or he can collect more than the insurance premium amount that he has paid.

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, if someone damages your vehicle, he is liable for said damages. If his insurance company covers the liability on his behalf, it is permissible to accept it, even if the amount is more than the premiums the damager paid to the insurance company. The agreement between the damager and his insurance company has no bearing on the liability owed to you by the damager.
