السلام عليكم و رحمة الله و بركاته
Dear Mufti Saheb.
Hope you are well.
I have a friend who is an Airtel Money Agent, who is very dedicated and hardworking.
The person is currently working for someone else, who has agents placed across Lusaka.
Looking at what the person makes a month, I would like to invest money (+/- K 10,000) with the person and make them an independent agent.
After calculating approximately how much they would make nett a month, they have said that they can give me K2000 a month as a return on investment.
Please advise if this sort of investment is shariah compliant.

In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
The described agreement is a partnership wherein one party will provide finance and the other shall do the work. If the agent is also contributing some capital, then it shall be a pure partnership between the two.
In either case, a necessary condition of permissibility is that the expected return of k2000 is not fixed as has been described, rather, a percentage of profits is fixed. For example, if the agent is actually making k4000 in profit per month, and he is willing to give you k2000 and keep k2000 for himself, this means he is willing to give 50% of profits to you. Therefore, the agreement should be that you are entitled to 50% of profits, which may fluctuate based on factual business during the month. Accordingly, k2000 is not guaranteed in any way. 50% of profits may be more or less than k2000. It is not permissible to fix k2000.
