Manager pocketing excess wages

Question
السلام عليكم و رحمة الله و بركاته حياك الله شيخنا و استاذنا الفاضل و الكريم و اثابك الله و حفظك من كل سوء.
شخص يسأل وهو رئيس العمال فى روسيا
وهو يتفق مع الناس للشغل على العدد مثلا يتفق أن الشغل يحتاج إلى ١٠ أشخاص، ولكن هو أحيانا يشغل ٧ أشخاص ثم يأخذ حصة ٣ فى جيبه، ماذا تقولون عن شأنه وماله؟
Translation:
A man is the head/manager of workers and he agrees with people/employers that the work will require 10 people but he sometimes only employs 7 people and takes the wage of the 3 in his pocket. What do you say about him and his wealth?
Answer
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
المال الحلال والطيب لازم للبركة في معيشة الرجل. المال المكسوب بالكذب والغرر حرام رجز.
في المسألة المسئولة، إذا اتفق الرئيس مع الناس ان الشغل يحتاج الي 10 أشخاص، لزمه أن يستخدم 10 أشخاص. اما إذا كان العمل يحتاج الي أقل من 10, والرئيس يكثّر العدد بلا سبب, فهذا غرر و حرام. لا يجوز له أخذ أجرة 3 أشخاص ويجب عليه رد الزيادة الي ملّاكها وهم الناس.
عَنْ أَبِي هُرَيْرَةَ: أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: َمَنْ غَشَّنَا فَلَيْسَ مِنَّا. رواه مسلم
Translation:
Halal and pure income is necessary for barakah in one’s livelihood. Income obtained through lies and deceit is Haram and filth.
In the enquired situation, if the manager agrees with his people/employers that he will require 10 people for a job, then he must employ 10 people for the job. If less people are required and he inflates the number of people, this is deceit and Haram. The excess wages of the 3 people must be returned to the owners/employers. It is not permissible for the manager to keep it.
Rasulullah Sallallahu Alaihi Wasallam said,[1]
عَنْ أَبِي هُرَيْرَةَ: أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: َمَنْ غَشَّنَا فَلَيْسَ مِنَّا
Translation: “Whoever deceives us is not from us.” (Muslim)
