Question
I manufacture gold jewellery with gemstones and diamonds in dubai and bring it to my country
However. Since i am in another country my dealings are over the phone
But i have the following system in place in order to ensure immediate transaction
I have a cash amana with the factory.
After they complete the item or items (sometimes we transact item by item or sometimes multiple items at once)
After completion. We do a spot transaction over the phone. In which they calculate the gold price as per the ongoing rate and add the added charges such as labour, premiums, gold lost in the process and diamonds added
The amount is deducted from my account/amana and i receive a slip/invoice to show the amount deducted and the item/items are kept aside as paid.
After which they keep the items on my behalf as an amana awaiting further instructions such as which courier to hand it over to. Or if i come to dubai i collect it from them
Is there anything wrong in this process considering that the full amount is deducted and the ownership of the item is mine. (Constructive possession) since i cannot physically take the items as I am in a different country
Answer
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
The purchase of gold/silver with cash/currency is permissible with the condition that atleast one of the parties takes possession of the item when concluding the transaction.[1] Therefore, if gold jewellery is being purchased, either the jewellery must be taken by the buyer, or the currency must be taken by the seller.
In the enquired situation, since the manufacturer/seller is taking possession of your cash which you have left with him, the transaction is valid and permissible even though the jewellery itself is still kept by the manufacturer/seller until further notice.
