Question
السَّلاَمُ عَلَيْكُمْ وَرَحْمَةُ اللهِ وَ بَرَكَاتُهُُ
What is the ruling of a secret nikaah in islam?
Answer
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
In principle, a valid nikah requires a proposal, an acceptance, and the presence of two male witnesses. If this is found, the nikah is valid. However, one of the primary purposes of nikah is to make Halal what was Haram. If a nikah is not made public, how will people know that what was Haram is now Halal? The bride and groom risk tainting their reputations in society by overlooking this important detail. Furthermore, if a secret nikah is done in order to escape the watchful eye of the guardians, then this is blameworthy and should not be done.
Rasulullah Sallallahu Alaihi Wasallam is reported to have said,[1]
عَنْ عَائِشَةَ، قَالَتْ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم أَعْلِنُوا هَذَا النِّكَاحَ وَاجْعَلُوهُ فِي الْمَسَاجِدِ وَاضْرِبُوا عَلَيْهِ بِالدُّفُوفِ
Translation: “Announce the Nikah, keep it in the masaajid, and strike the duff (a type of drum) for it.” (Tirmidhi – 1089)
