What is the ruling on miscarrying whilst the fetus is 7 weeks old?
Is it haidh or nifaas?
And should one begin counting days of nifaas after fetus has been expelled from the body or from when bleeding begins whilst fetus is still in the body?
Answer
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
In principle, nifaas is only when a woman bleeds after giving birth to or miscarrying a foetus whose body limbs had formed.[1]
At 7 weeks, it is still too early for limbs to have formed. Accordingly, the bleeding experienced will be treated as haidh if it fulfils the minimum requirement of haidh i.e. 3 days. Otherwise, less than 3 is istihaadha. The woman will then apply the rules of her haidh and purity habits from before pregnancy.
The count will start after the foetus came out of the body.
