Question
Assalamu Alaikum Wa Rahmatullahi Wa Barakatuh,
I would like to ask about a situation regarding online forex trading and the ruling concerning money that has already been earned and spent.
I previously traded forex through Exness using MT5 and leverage. I traded currency pairs and XAU/USD. I did not knowingly trade any commodities other than gold.
I initially deposited $500 of my own halal money into the trading account. Through trading, I eventually made approximately $5,000 in profit. I have already withdrawn and spent that approximately $5,000 profit.
At present, my trading account has approximately $1,000 remaining. Of this, approximately $500 is my original capital, while the other approximately $500 represents profit from the forex trading.
I have now learned that leveraged online forex trading is considered impermissible according to the Hanafi ruling.
My questions are:
1. Is the approximately $5,000 profit I already earned and spent considered haram wealth?
2. If it is considered haram wealth, am I required to give away an equivalent $5,000 from my current/future halal wealth, even though the original money has already been spent?
3. For the approximately $500 profit that is still remaining in my account, should I give this amount away to the poor/needy as disposal of haram wealth?
4. Is my original $500 capital still completely halal and permissible for me to keep?
5. Is there any additional kaffarah, sadaqah, or compensation required beyond disposing of the impermissible wealth?
6. What should I do regarding the money I have already spent from the approximately $5,000 profit?
I would appreciate a clear ruling according to the Hanafi madhhab, specifically regarding what I am required to do with the money that has already been spent.

As for your other queries,
- If it was the proceeds of impermissible forex trade, then yes.
- If the funds were spent in consumables, you should make tawbah and istighfaar. If a specific item was purchased with it which you still possess, you should get rid of it and give it in sadaqah.
- The default ruling is that your capital remains permissible. However, given that you already utilised Haram proceeds in excess of that, it would be better to give away the full amount in sadaqah.

- Tawbah, istighfaar and disposal of any item you still have which was purchased directly with those Haram funds.
