Question

Assalamualaikum wa rahmatullahi wa barakatuhu

There is a lady who has been having continuous bleeding after childbirth. After 40 days she was told to make ghusal and start parting namaz and fasting because it is istehaza.But bleeding is continuous and stops for only 2-3 days in taking medication then starts bleeding again,its been 2.5 to 3 months. Now she wants to know when can she start fast? when will it be her haidh and when would it be istehaza?

Habit was 20 days tuhur and 5 days haidh

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, a Nifaas and a valid Haidh must be separated by a valid Tuhr in-between. You state that you experienced continuous bleeding even after your Nifaas ended. Your previous habits are 20 days Tuhr and 5 days Haidh.

Accordingly, after your 40 days of Nifaas ended, the next 20 days were your Tuhr i.e. you must perform Salah and fast therein. The next 5 days were your Haidh i.e. you will stop performing Salah and fasting. Thereafter, 20 days of Tuhr, followed by 5 days of Haidh. This cycle will continue as long as you experience continuous bleeding. Due to continuous bleeding, your days of Tuhr will be Istihaadha.

You should therefore calculate 20 Tuhr – 5 Haidh from the time your Nifaas ended to ascertain your Tuhr and Haidh days this month and fast accordingly.
