Married couple sleeping in separate rooms

Question

Would a marriage still be valid if a husband and wife sleep in separate rooms due to not getting along for numerous years. The wife gave him permission to remarry but he refuses and wants to be a father for his 5 grown children. They have agreed to be civil and not divorce for children’s sake. Is this allowed?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The marriage is still intact and valid. Having said that, realistically, the primary purpose of marriage is to fulfil one’s sexual desires in a halal manner. Putting aside the fact that each spouse is violating the natural rights of the other, if the couple remains in this state, for how long will they be able to protect themselves from Haram?
