Question

Assalamu alaikum Mufti Sahab,

Yesterday night I was sleeping at my home my daughter 2 years old was disturbing to me I was tired and was in deep sleep, same time my wife was performing Isha salah around 1AM in another room, I woke up from the sleep in anger that why my wife is not stoping my daughter from disturbing me, I scold her and argument started she said “Kya my namaz nahi padna” I said in anger “Nahi padna” but my intention was not that am doig INKAR of namaz but due to anger I said dont pray my intention was dont pray at this time atleast take the baby away from me then pray. I know I have mistaken and am feeling guilty for what I have said. Immediately after this incident I have read Kalima Shahadat.

Mufti Sahab could you please tell me am I out of Islam and Is my Nikah valid or do I have to do Tajdeed Nikah?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Respected Brother,

Matters of deen are not to be taken lightly, in haste or in anger. Your daughter is merely two years old. It was not correct of you to portray such behaviour. Such an outburst was uncalled for and nearly cost you your faith. It goes without saying that you need to make sincere Tawbah immediately and beg Almighty Allah for forgiveness. You should also endeavour to give some charity to amend for your outburst.

You state that you were not rejecting the tenet of Salah, rather you meant to say don’t pray at this time/place. Your Imaan is still intact.[1] You did well to realise your error and even repeat the Shahaada. Be cautious of your statements in the future and take practical steps towards controlling your anger.

Keep in mind that your wife has obligations towards you as well as her Lord. She was simply fulfilling her duty by performing Salah. It is not conduct becoming of a Muslim to chastise his wife when she is offering her duties whilst caring for the young child.

وَمَا كَانَ فِي كَوْنِهِ كُفْرًا اخْتِلَافٌ يُؤْمَرُ قَائِلُهُ بِتَجْدِيدِ النِّكَاحِ وَبِالتَّوْبَةِ وَالرُّجُوعِ عَنْ ذَلِكَ احْتِيَاطًا وَمَا كَانَ خَطَأً مِنْ الْأَلْفَاظِ لَا يُوجِبُ الْكُفْرَ فَقَائِلُهُ مُؤْمِنٌ عَلَى حَالِهِ وَلَا يُؤْمَرُ بِتَجْدِيدِ النِّكَاحِ وَلَكِنْ يُؤْمَرُ بِالِاسْتِغْفَارِ وَالرُّجُوعِ عَنْ ذَلِكَ، هَذَا إذَا تَكَلَّمَ الزَّوْجُ فَإِنْ تَكَلَّمَتْ الزَّوْجَةُ فَفِيهِ اخْتِلَافٌ فِي إفْسَادِ النِّكَاحِ وَعَامَّةُ عُلَمَاءِ بُخَارَى عَلَى إفْسَادِهِ لَكِنْ يُجْبَرُ عَلَى النِّكَاحِ وَلَوْ بِدِينَارٍ وَهَذَا بِغَيْرِ الطَّلَاقِ

فقال: وما كان خطأ من الألفاظ ولا يوجب الكفر فقائله يقر على حاله، ولا يؤمر بتجديد النكاح ولكن يؤمر بالاستغفار والرجوع عن ذلك، وقوله احتياطا أي يأمره المفتي بالتجديد ليكون وطؤه حلالا باتفاق، وظاهره أنه لا يحكم القاضي بالفرقة بينهما، وتقدم أن المراد بالاختلاف ولو رواية ضعيفة ولو في غير المذهب

ما كان في كونه كفرا اختلاف فإن قائله يؤمر بتجديد النكاح وبالتوبة والرجوع عن ذلك بطريق الاحتياط وما كان خطأ من الألفاظ ولا يوجب الكفر فقائله مؤمن على حاله ولا يؤمر بتجديد النكاح والرجوع عن ذلك كذا في المحيط إذا كان في المسألة وجوه توجب الكفر ووجه واحد يمنع فعلى المفتي أن يميل إلى ذلك الوجه كذا في الخلاصة في البزازية إلا إذا صرح بإرادة توجب الكفر فلا ينفعه التأويل حينئذ كذا في البحر الرائق ثم إن كانت نية القائل الوجه الذي يمنع التكفير فهو مسلم وإن كانت نيته الوجه الذي يوجب التكفير لا تنفعه فتوى المفتي ويؤمر بالتوبة والرجوع عن ذلك وبتجديد النكاح بينه وبين امرأته كذا في المحيط
