Question

Assalamualaikum Mufti,

Please assist with below query.

I am a single lady. Never married and with no children. My parents and grandparents have all passed on. I am survived currently by one brother and three sisters.

I own a piece of land and have some valuables.

1) Kindly advise how my inheritance should be distributed upon my demise based on the Laws of Shariah.

2) While i am still alive, can i bequeath the piece of land and any structure on same land to any one of my relatives.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Sister in Islam,

We commend you on your sensitivity on distributing your estate according to the Shariah Law of Succession and Inheritance. This stems from your conscious of Imaan.

At the outset, one should understand that the Laws of inheritance will only be applied after one’s demise.

According to the Shariah Law of Succession and Inheritance, distribution of an estate will only commence after funeral expenses, which should not be extravagant nor miserly.

Thereafter all debts (including legal costs) and bequests (if any) made to non-heirs – which will not exceed one-third (1/3) of the Estate should be paid.

Thereafter, all assets form part of the Net Estate and will be distributed according to the Islamic Law of Succession and Inheritance.

  • According to the Shariah laws of Inheritance and Succession, if there are no other heirs besides a brother and three sisters, then the estate will be divided into 5 equal shares as follows:

The brother will inherit in the ratio 2:1 to the sisters.

  • In principle, one is permitted to bequest only up to one-third (1/3) of the Estate. A bequest can be made for non-heirs only. A bequest cannot be made for an heir.[1] [2]

This is understood from the following Hadeeth:


عَنْ شُرَحْبِيلَ بْنِ مُسْلِمٍ، سَمِعْتُ أَبَا أُمَامَةَ، سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقُولُ ‏ “‏ إِنَّ اللَّهَ قَدْ أَعْطَى كُلَّ ذِي حَقٍّ حَقَّهُ فَلاَ وَصِيَّةَ لِوَارِثٍ ‏”‏

Translation: Abu Hurayrah narrates: I heard Nabi (Sallallahu Alayhi Wasallam) saying:

 Allah has appointed for everyone who has a right what is due to him, and no bequest must be made to an heir.

(Sunan Abu-Dawood)

 

One should not deprive an heir of his/her share of inheritance by giving away all his wealth to charity. One will be sinful for depriving an heir from his/her share.

بدائع الصنائع في ترتيب الشرائع (7/ 337)

(ومنها) أن لا يكون وارث الموصي وقت موت الموصي، فإن كان لا تصح الوصية لما روي عن أبي قلابة – رضي الله عنه – عن رسول الله – صلى الله عليه وسلم – أنه قال «إن الله تبارك وتعالى أعطى كل ذي حق حقه، فلا وصية لوارث» وفي هذا حكاية، وهي ما حكي أن سليمان بن الأعمش – رحمه الله تعالى – كان مريضا، فعاده أبو حنيفة – رضي الله عنه – فوجده يوصي لابنيه، فقال أبو حنيفة: – رضي الله عنه – إن هذا لا يجوز، فقال: ولم يا أبا حنيفة فقال: لأنك رويت لنا أن رسول الله – صلى الله عليه وسلم – قال: «لا وصية لوارث» فقال سليمان – رحمه الله -: يا معشر الفقهاء أنتم الأطباء ونحن الصيادلة

فقد نفى الشارع – عليه الصلاة والسلام – أن يكون لوارث وصية نصا

أخبرنا أبو سهل محمد بن عبد الله بن سهل بن حفص قال: أخبرنا أبو عبد الله قال: أخبرنا أبي عن محمد بن الحسن عن أبي يوسف عن عبد الله بن محرز عن قتادة عن أبي قلابة يرفعه إلى النبي – صلى الله عليه وسلم – أنه قال: “لا وصية لوارث”

محمد قال: حدثنا أبو حنيفة عن عطاء بن السائب عن أبيه عن سعد بن أبي وقاص أنه قال: يا رسول الله، أوصي بمالي كله؟ قال رسول الله – صلى الله عليه وسلم -: “لا”. قال: فبنصفه؟ ، قال: “لا”. قال: فبثلثه؟ ، قال “الثلث، والثلث كثير؛ إنك أن تدع عيالك أغنياء خير من أن تدعهم فقراء يتكففون الناس”

(وَأَمَّا) السُّنَّةُ فَمَا رُوِيَ «أَنَّ سَعْدَ بْنَ أَبِي وَقَّاصٍ – رَضِيَ اللَّهُ عَنْهُ – وَهُوَ سَعْدُ بْنُ مَالِكٍ كَانَ مَرِيضًا فَعَادَهُ رَسُولُ اللَّهِ – صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ – فَقَالَ يَا رَسُولَ اللَّهِ: أُوصِي بِجَمِيعِ مَالِي؟ فَقَالَ: لَا، فَقَالَ بِثُلُثَيْ مَالِي؟ قَالَ: لَا، قَالَ: فَبِنِصْفِ مَالِي؟ قَالَ: لَا قَالَ: فَبِثُلُثِ مَالِي؟ فَقَالَ – عَلَيْهِ السَّلَامُ – الثُّلُثُ، وَالثُّلُثُ كَثِيرٌ إنَّكَ أَنْ تَدَعَ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ تَدَعَهُمْ عَالَةً يَتَكَفَّفُونَ النَّاسَ»

وَرُوِيَ: فُقَرَاءُ يَتَكَفَّفُونَ النَّاسَ فَقَدْ جَوَّزَ رَسُولُ اللَّهِ – صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ – الْوَصِيَّةَ بِالثُّلُثِ

وَرُوِيَ عَنْهُ – عَلَيْهِ الصَّلَاةُ وَالسَّلَامُ – أَنَّهُ قَالَ: «إنَّ اللَّهَ – تَبَارَكَ وَتَعَالَى – تَصَدَّقَ عَلَيْكُمْ بِثُلُثِ أَمْوَالِكُمْ فِي آخِرِ أَعْمَارِكُمْ زِيَادَةً عَلَى أَعْمَالِكُمْ فَضَعُوهُ حَيْثُ شِئْتُمْ»

أَخْبَرَ – عَلَيْهِ الصَّلَاةُ وَالسَّلَامُ – أَنَّ اللَّهَ تَبَارَكَ وَتَعَالَى جَعَلَنَا أَخَصَّ بِثُلُثِ أَمْوَالِنَا فِي آخِرِ أَعْمَارِنَا لِنَكْسِبَ بِهِ زِيَادَةً فِي أَعْمَالِنَا

وَالْوَصِيَّةُ تَصَرُّفٌ فِي ثُلُثِ الْمَالِ فِي آخِرِ الْعُمْرِ زِيَادَةٌ فِي الْعَمَلِ فَكَانَتْ مَشْرُوعَةً
