Question
Assalamualaikum Sheikh, hope you’re well.. mirath question.
can mirath be revoked after it was distributed?
10 years ago a Lady was given 1.2 acres.
– 1 year later they reassessed and made removed .2acres and made it 1 acre without her permission, but she agreed to keep peace.
– 8 years later she put up a wall fence and they claimed the plans that she was given by them was wrong
– she paid to have the same land surveyor come back and confirm beacons based on original coordinates
– he confirmed her plans and she built the wall
Now she’s asking if she will be held accountable in Allah’s court?
Answer
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
Inheritance shares are divinely prescribed, as such, Muslims are bound to follow them.
The lady’s share of the land must be in proportion to her share of the inheritance. If she is able to verify this then that is the best option.
You state that the lady was initially given 1.2 acres which was then reduced without her permission. If she agreed to this, then she has willingly let go of her right and cannot reclaim it. If she did not permit it willingly, but was pressured to do so, then she may claim her original rights.
The same applies to building the wall fence around her property.
