Question

There are two parts to this query:

  1. Someone said that there is no qadha for salah missed intentionally. And the following three videos say that Qadha Salah is only necessary for those salahs missed due to sleepiness or forgetfulness.

Does that mean that Qadha is not needed for those salah that were missed intentionally and simply asking for forgiveness will suffice??

  1. Where Qadha is necessary, what is the correct method of praying it – I read somewhere they must be prayed in order – what if the number and days salah was missed is not remembered? Also are there restricted times for praying Qadha such as at Fajr and Asar times where praying other Nafl salah is not recommended.

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

There is a consensus of the Ulama that whoever intentionally misses a salah is required to make qadha of it. And whoever opposes this, opposes Ijmaa’ (consensus).

Based on prophetic narrations, forgetfulness is a cause that shari’ah has overlooked. For example, if a fasting person forgetfully eats or drinks, then his fast remains intact. Keeping that in mind, when Rasulullah Sallallahu Alaihi Wasallam is ordering us to now make qadha of Salah even though it was left out due to forgetfulness, then that shows the magnitude of Salah, as it requires atonement even though forgetfulness was the cause. From the hadith, one deduces a priori, if despite forgetfulness one is required to make qadha, then it is more obvious that intentionally doing so will result in qadha being necessary. It is absurd to think that when qadha remains mandatory for something out of your control (forgetfulness), it will drop off for something within your control especially since regarding fasting, forgetfulness is overlooked whereas intentionally breaking the fast necessitates both qadha and kaffarah.

Therefore, based on the consensus across the madhaahib, it is necessary to make qadha of all salah missed intentionally. It is unfortunate that people with inept knowledge of shari’ah now possess platforms to misinform the people.

أَجْمَعَ الْعُلَمَاءُ الَّذِينَ يُعْتَدُّ بِهِمْ عَلَى أَنَّ مَنْ تَرَكَ صَلَاةً عَمْدًا لَزِمَهُ قضاؤها وخالفهم أبو محمد على ابن حزم فقالا لَا يَقْدِرُ عَلَى قَضَائِهَا أَبَدًا وَلَا يَصِحُّ فِعْلُهَا أَبَدًا قَالَ بَلْ يُكْثِرُ مِنْ فِعْلِ الْخَيْرِ وَصَلَاةِ التَّطَوُّعِ لِيَثْقُلَ مِيزَانُهُ يَوْمَ الْقِيَامَةِ وَيَسْتَغْفِرُ اللَّهَ تَعَالَى وَيَتُوبُ وَهَذَا الَّذِي قَالَهُ مَعَ أَنَّهُ مُخَالِفٌ لِلْإِجْمَاعِ بَاطِلٌ مِنْ جِهَةِ الدَّلِيلِ وَبَسَطَ هُوَ الْكَلَامَ فِي الِاسْتِدْلَالِ لَهُ وَلَيْسَ فِيمَا ذَكَرَ دَلَالَةٌ أَصْلًا
